On March 20th 2014 Thessaloniki’s Court of Appeal condemned in a second degree trial one of the co-administrators of the most popular Greek piracy websites, «gamato.info», to six (6) months of imprisonment. It is the first final judgement of a Greek penal court against the co-administrator of a webpage containing torrent files, which enabled sharing and access to audiovisual and other material (feature films, series, music, software etc).
This decision is particularly important because, among other things, it recognizes the independent penal responsibility of individuals acting as co-administrators without being owners of an illegal webpage.
It has to be pointed out that trials are yet to be held, in various courts across the country, concerning seven (7) more individuals, who participated in the operation and management of «gamato.info». Among those are its owners.
On March 18th 2014 Thessaloniki’s Felonies’ Court of Appeal condemned the owner and administrator, as well as the co-administrator, of the webpage «greekstars.biz». It imposed six (6) years of imprisonment and a ten thousand (10.000) euro fine to the first and three (3) years of imprisonment to the latter.
“Greekstars.biz” webpage, which offered links directing to audiovisual material (films, series etc) among other things, belongs to a series of webpages having “greekstars” as a main domain. They have been created by the same person in order to avoid consequences of the penal prosecutions against him, following four (4) complaints in total (2009, 2010, 2011 and 2013) brought against him by EPOE (Society for the Protection of Audiovisual Material).
Apart from this decision two bills of indictment have been issued against the same owner and administrator on the charges of felony violation of copyright laws. The trial of cases concerning the other complaints is expected within the next few months.
[These court decisions are part of a series of verdicts of guilt that have been issued following actions taken by EPOE and complaints brought by it from 2009 until today against owners and administrators of webpages, through which audiovisual material and subtitles were being illegally diffused. These websites included blogspot pages and Facebook accounts and the decisions were carrying out a plan of action to confront internet piracy across the country.
Relative decisions have been issued by the Dodecanese Felonies’ Court of Appeal and Athens’ Misdemeanors Court, condemning the owners and administrators of the websites greek-fun.com (three-year imprisonment) and geomelitini.blogspot.gr (one-year imprisonment).
It is noted that within the next few months trials will be held in penal courts across the country concerning cases of felony against other owners and administrators of piracy webpages.
